The guarantee terms and conditions below determine the scope of the Huvema guarantee and the
conditions under which it will be provided, without prejudicing the vendor’s mandatory guarantee
obligations and the sales contract signed with the end-user.
Huvema provides a guarantee for machinery, in accordance with the following conditions:
a) Deficiencies that can be attributed to material and/or production errors will be repaired for free,
while taking into account the conditions below (section b to f), as long as the deficiencies are reported
to Huvema immediately upon discovery and within 24 months – if the item is being used commercially
or has similar use this shall reduce to 12 months – after delivery to the end-user. The 12 month period
also applies to demonstration machinery. The guarantee period for used machinery shall be
determined upon order confirmation. If the deficiency is discovered within six months of delivery, it will
be assumed that the deficiency was present upon delivery.
b) Light, fragile items such as glass or plastic light bulbs are not covered by the guarantee.
No claim shall be made under the guarantee in the case of limited deviations from the desired
properties inasmuch as these are not significant to the value and functionality of the equipment or in
the case of damage as a consequence of the chemical or electrochemical effect of water and, in
general, as the result of abnormal environmental factors, inferior commercial conditions or contact with
substances to which the equipment is not resistant.
There shall also be no claim under the guarantee if the deficiencies can be attributed to incorrect
usage, defective maintenance or a lack of consideration of use or assembly instructions.
A claim under the guarantee shall be null and void if repairs or interventions are carried out by persons
who have not been authorised by Huvema or if the machine is fitted with spare parts, extensions or
accessories that are not original parts and a deficiency is caused as a result.
c) Guarantee claims shall be dealt with in such a way that inferior parts will be repaired for free or
replaced by sound parts, according to an assessment by Huvema. Huvema shall determine whether
the machine will be repaired on location or at the Huvema workshop. A claim for repair at the relevant
location is only possible if the Huvema planning department has provided the client with a definite
date. A return form must be completed for any repairs that take place in the workshop. If this is under
guarantee, the cost for this shall not be passed on, if it is not, the costs will be charged. Any service
shall only be provided upon submission of the sales receipt with a sale and/or delivery date. Replaced
parts become the property of Huvema.
d) If repair work cannot reasonably be carried out by Huvema, the end-user may request that
replacement equipment, for the same value, be provided within the aforementioned guarantee period.
When providing a replacement machine, Huvema retains the right to charge a reasonable fee for the
period of usage up to that moment.
e) Claims under the guarantee shall not lead to an extension of the guarantee period and do not
constitute the beginning of a new guarantee period. The guarantee period for built-in spare parts ends
at the same time as the guarantee period for the equipment in its entirety.
f) More extensive or other claims – in particular, claims for the reimbursement of damage caused
outside of the equipment – are not permitted insofar as liability does not arise as a result of legal
definitions of imperative law.
The current guarantee conditions apply to machinery purchased in the Netherlands and Belgium. In
addition, the current guarantee conditions apply to equipment intended for shipment abroad, which
complies with the technical conditions (e.g. voltage, frequency, gas types, etc.) of the relevant country
and which is suitable for use with the prevailing climatic and environmental factors.
